Public reports
The New York State Workers' Compensation Board publishes the following public reports each year:
- Annual Assessment Rate: Pursuant to Workers' Compensation Law §151, the Chair of the Workers' Compensation Board annually establishes an assessment rate for all employers by November 1 of each year, to be effective January 1 of the subsequent calendar year. The annual assessment rate is announced each year via Subject Number.
- Annual Report: Pursuant to Workers' Compensation Law § 153, the Board issues an annual report, which states in detail the work the Board has done in hearing and deciding cases and related aspects of the Board's operations, including assembly and adjudication of workers' compensation claims and payer compliance. The Board's annual report is published by February 1 of each year, and current and past issues are accessible here on the Publications page (see below).
- Regulatory Agenda: Pursuant to section 202-d of the State Administrative Procedures Act, the Workers' Compensation Board must provide notice of rules that the Board is considering proposing, but for which a rule making proceeding has not been commenced. The notice also provides small businesses, local governments, and public and private interests in rural areas with the opportunity to participate in the rule-making process, as provided for in sections 202-b and 202-bb of the State Administrative Procedures Act. The Board's regulatory agendas are published on the Regulations page of this website.
