An amendment to Section 13-b of the New York State Workers' Compensation Law went into effect earlier this year to extend the ability to treat injured workers to residents and fellows (under the supervision of an authorized physician). The Chair proposes amendments to Section 329-1.3 of Title 12 of the NYCRR (a new subdivision [e]) to help implement this law by providing guidance about billing procedures when services are provided by residents and fellows under the supervision of a New York State Workers' Compensation Board-authorized physician.
The Notice of Proposed Rule Making will be published in the January 7, 2026, edition of the State Register. Comments on the proposal will be accepted for 60 days after publication. Please submit comments by emailing regulations@wcb.ny.gov.
