Regulations Adoption of Amendments to Section 329-1.3 of Title 12 of the NYCRR (Billing Guidance for Residents and Fellows)

Regulations

April 6, 2026

An amendment to Section 13-b of the New York State Workers' Compensation Law went into effect earlier this year to extend the ability to treat injured workers to residents and fellows (under the supervision of an authorized physician).

The Chair has adopted the addition of a new subdivision (e) of section 329-1.3 of Title 12 of the NYCRR to help implement this law by providing guidance about billing procedures when services are provided by residents and fellows under the supervision of a New York State Workers' Compensation Board-authorized physician.

The Notice of Proposed Rule Making was published in the January 7, 2026, edition of the State Register. The Notice of Adoption will be published in the April 22, 2026, edition of the State Register. The amendments will take effect upon publication of the adoption in the State Register.
